Hospital Injuries:
Hospitals want you to come to their facilities. They advertise to get
you to come to them for help. They often provide emergency departments
and anesthesiologist, as well as radiology departments, respiratory
therapist, nurseries, intensive care departments, cardiac care units,
pharmacists and nurses. They also provide other facilities, diagnostic
tests and other personnel. Some hospitals even provide doctors.
If a hospital's
services are not provided in accordance with the standard of care, it
may be liable to you if its breach of a duty causes you or your loved
ones an injury.
In addition to being liable for the acts of these health care providers
and its equipment, the hospital has an independent duty to supervise
the physicians rendering care to the patients and may be
liable to you if it breaches this duty. Moreover, some hospitals have
permitted doctors to practice at their facility when the doctor did
not have the necessary credentials to practice; other hospitals have
permitted physicians to continue practice after the hospital was on
notice that the doctor was not practicing in accordance with accepted
practices. Additionally, according to the Physician's Health Plan, a
project of the North Carolina Medical Board and The North Carolina Medical
Society, approximately 15% of North Carolina's doctors are impaired
from the use of drugs, alcohol or psychiatric problems to such degree
that they are not able to safely treat patients. Hospitals have a role
to play in protecting people from injury from impaired physicians and
failure to take proper steps to protect patients may result in the hospital's
liability for a person's injury.
